Lindsay Lohan attorney Alfred Gerisch filed a brief late last week supporting the starlet's request for the dismissal of all or part of a negligence suit that had been filed against her over an October 2005 car crash, according to Los Angeles TV station CBS 2. In the brief, Gerisch claimed Raymundo Ortega is using lies about Lohan being drunk at the time of the crash "as a battering ram to force a settlement." Gerisch cited as the evidence a police report that called Lohan an "innocent victim" and stipulated alcohol was not involved in the incident, although Ortega's attorney Robert G. Klein has called the document hearsay. A hearing on Lohan's motions is set for Tuesday in Los Angeles Superior Court. ...

Lopez had filed the breach-of-contract lawsuit over Noa's plans to publish a tell-all book in which he was expected to claim Lopez had multiple affairs. Solner also told Noa to give Lopez all copies of materials related to the book, and denied his request for another 30 days to find a lawyer. ...

It sounds like fans aren't feeling the American Idols Live Tour this time around. Halfway through the outing, there were no sellouts for the first 30 shows on the tour, with only one date topping the 93 percent capacity mark — a gig in winner Jordin Sparks' home state of Arizona — Billboard Boxscore reports. Compare that to last year's tour, which boasted appearances from Taylor Hicks, Chris Daughtry, Katharine McPhee and Elliott Yamin — and had 17 sellouts in its first 30 dates and 10 shows with more than 93 percent capacity. Boxscore reports 14 of first 30 shows for the current tour were below 60 percent capacity and a gig in Birmingham, Alabama, was at an anemic 38.9 percent. ...

In fact, Zombie isn't even so sure he'll be sticking to horror when it comes to his recent deal with Dimension Films. "I signed up for two more pictures, but not two more 'Halloween' pictures. As I Lay Dying, In Flames Confirmed For Sounds Of The Underground

Festival's second incarnation also snags Cannibal Corpse, Trivium, Behemoth, Black Dahlia Murder.
By Chris Harris

As I Lay Dying

Last summer Ozzfest — the Goliath of metal and hardcore carnivals — faced, for the first time since its debut, some serious competition. The David, in this case, was the Sounds of the Underground tour. The inaugural run lived up to its name, with unorthodox acts like Lamb of God, Clutch, Opeth, Poison the Well, Strapping Young Lad, Gwar and Unearth rounding out the bill, along with a dozen other black-, death- and thrash-metal stalwarts.

The trek was such a success that the organizers are returning this year with the second installment of SOTU, which will feature headliners and Ozzfest 2005 vets As I Lay Dying.

The SoCal metalcore unit — which is spending the spring with the Deftones on the Taste of Chaos tour (see "Taste Of Chaos '06 Tour Dates Revealed") — will be joined by several of the genre's other big names for SOTU. Confirmed so far are Gwar, Swedish melodic death-metallers In Flames, Florida's Trivium and Cannibal Corpse, Californian hardcore band Terror, Detroit death-metal troupe the Black Dahlia Murder, Polish power-metal trio Behemoth, the Chariot and South Carolina death-metal collective Through the Eyes of the Dead.

The Sounds of the Underground organizers are taking a different approach to this summer's festival by keeping the number of bands on the bill down and extending the length of set times. Last year most bands got no more than 30 minutes to play.

While dates for the trek — including the official launch date — are still being worked out, SOTU will return to Denver, St. Louis, Chicago, Detroit, Toronto, Philadelphia, San Francisco and Los Angeles, as well as cities in Texas, New England and western Canada. Tickets will go on sale in late March.

More bands will be announced in the coming weeks.

New Releases: Nas, Styles P, Trick Daddy, Bow Wow, DJ Clue & More

Also due Tuesday: Bullet for My Valentine, RBD, Blak Jak, Grand Hustle Presents: In Da Streetz Volume 4, Neil Young.
By Kurt Orzeck

There are probably more coins in your pocket right now than there are new releases this week, but don't forget about that big fat precious silver dollar with an "N" on it that's jingling around. That's right: If this week's batch of fresh titles has a mantra, it's "Make Way for Nas."

UGK and Mos Def — and Katharine McPhee, for that matter — postponed their upcoming efforts, clearing the battlefield so Nasty Nas can wreak havoc. A few other hip-hop artists are holding strong against the big guy, though: Styles P, Trick Daddy, Bow Wow and DJ Clue are also laying out fresh slices, and no less than T.I. is anteing up with a spic-and-span compilation from his label, Grand Hustle.

But if you're not into hip-hop, this might be a good week to take a nap: Aside from a Bullet for My Valentine DVD and a Neil Young reissue, rock fans probably won't be debating which new title to spend their money on this week.

Not that he has any reason to worry, but here's the competition Nas is facing this week, and a reason why he can expect to trounce every one of them:

Styles P's Time Is Money: Despite the cautious title of his new LP, the former LOX-er took a spell to put out the follow-up to 2002's A Gangster and a Gentleman. But now Styles has finally come around to do the whole sophomore thing, and he's galvanized his friends for the affair: The LOX reunite for a remix of "Who Want a Problem," which also features Swizz Beatz; Mario Winans throws down on "Can You Believe It"; Talib Kweli guides Styles to "Testify"; Gerald LeVert joins him for "Real Sh--"; Sizzla shows him through "Fire & Pain"; and the band Flipsyde re-emerge to help Styles "Burn One Down."

Why Nas Will Beat Him: On his new one, Hip Hop Is Dead, Nas' guests include Jay-Z ("Black Republican"), Snoop Dogg ("Play on Playa"), the Game and Floetry's Marsha Ambrosius ("Hustlers"), Will.I.Am ("Hip Hop Is Dead"), Kelis ("Not Going Back"), newcomer Chrisette Michele ("Can't Forget About You," "Hope" and "Still Dreaming") and, last but not least, Kanye West (also on "Still Dreaming").

Trick Daddy's Back by Thug Demand: Chamillionaire, Jaheim, Trey Songz, Trina, Baby, 8Ball and others are helping Trick-Trick celebrate his seventh solo LP. "There are people out there that ain't got nowhere to stay," he said in his most recent press bio. "All they can do is rob or gamble or steal or sell dope. I put people on the level where they can relate and understand what other people go through."

Why Nas Will Beat Him: Because as gritty a concept as Trick Daddy is bringing to the table, Nas' is way more controversial. Hip Hop Is Dead sparked a flurry of debate and outrage before its release, even provoking Ludacris to wear to the BET Hip-Hop Awards a T-shirt that read "Hip-hop is not dead, it lives in the South." Even Nas seems to be taking the other side of the debate on "Hope," which includes the lyric "Hip-hop will never die."

Bow Wow's The Price of Fame: Few rappers have put out five albums before breaking out of their teens, but Bow can now consider himself part of that elite crew. Perhaps to help him grieve over former girlfriend Ciara, who he waxes about on his new effort, the rapper enlisted some help, including Chris Brown and Jermaine Dupri. As a bonus, he doled out signed copies of his album to fans who preordered.

Why Nas Will Beat Him: Nas didn't sign any preorders, but he is gifting early birds who use iTunes with something perhaps even better: an exclusive track called "Shine On!"

DJ Clue's The Professional 3: A Roc-A-Fella co-conspirator for about a decade, the mixtape guru from Queens, New York, sure knows how to attract rap's biggest names. The roster this time around includes Young Jeezy, Lil Wayne, Juelz Santana, Jadakiss, Swizz Beatz, Paul Wall, Beanie Sigel, Fabolous, Styles P and Kanye West.

Why Nas Will Beat Him: Because even though Clue has been in Jay-Z's good graces for years, it's the man Jay beefed with for years that he's putting all his power behind to promote. Expect Nas' new one to overshadow his labelmate's latest.

Various artists' Grand Hustle Presents: In Da Streetz Volume 4: T.I. has been dishing In Da Streetz comps since 2002, but finally the mixtape series is getting some extra cred by going retail for its fourth volume. Hoping to piggyback on Tip's five Billboard Awards, the 14-track platter features Young Jeezy ("Top Back" remix), Young Dro ("My Girl"), Yung Joc ("Yeah" remix) and others.

Why Nas Will Beat Them: Those "others" include Xtaci, Alfamega, Macboney and other newcomers. Nas fans, on other hand, won't be distracted by much fresh blood on his new one.

Bullet for My Valentine's "The Poison - Live at Brixton" DVD: The Welsh metalheads have only been around for three years, but they've already proved their salt by selling out the U.K.'s vaunted Brixton Academy for this filmed concert involving 15 cameras. Beyond the live material, there are eight episodes from the band's life-on-the-road "Bullet TV" series, plus an additional hour's worth of videos and more.

Why Nas Will Beat Them: Uh, because it's a rock album?

Neil Young's Living With War - Raw: This limited special edition is boosted by a DVD containing in-the-studio footage for each of the politically charged album's 10 tracks.

Why Nas Will Beat Him: Because it's Nas versus Neil Young.

Jack Johnson's To The Sea: Hear It Now On The Leak!

New album forgoes polished production to remind listeners 'that it's humans doing it.'
By James Montgomery

Jack Johnson's To the Sea — available to stream right now on MTV's The Leak — is an album born out of happy accidents. A flubbed chord here, a stray snare snap there — it's lively and warm and intimate, sounding very much like a band getting together in a room and just playing.

Which was precisely the goal, as Johnson told MTV News earlier this year.

"With the technology these days, you can look at music instead of listening to it sometimes," he said. "You can look and say, 'Oh yeah, see, the bass drum doesn't line up with the guitar hit there, let's move that.' [And] we tried not to do that on this one. Sometimes, when things don't line up, it actually makes it them better. You listen to old records, when they didn't have the capability of cutting things together, that's the magic of it. ... It reminds you that it's humans doing it."

And Sea is very much a human record, full of crackling instrumentation and Johnson's ruminations on life, love and spirituality. The title track explores "the archetype of the wild man ... deep down in the mind, waiting to be discovered." First single "You and Your Heart" is about the internal struggle between the heart and the brain — "That area you get in sometimes, where you stop trusting your heart and you start thinking too much," as Johnson put it. And "At or With Me," well, it's just a fun, funky tune, recorded live and left untouched.

"That's a really fun track," Johnson said. "We did it one time, thinking it was just demo-ing. ... It was one take, one time, and that's the tone on the album."

All in all, there's a whole lot of energy on To the Sea. But why bother reading about it when you can hear the album for yourself? Though it doesn't hit stores until June 1, you can hear it right now over on The Leak. Consider it an early, and very human, start to your summer.

Jack White Says Dead Weather Will Record Second Album Soon

'We've got a lot of songs cooking right now,' the frontman of material for a new record.
By Kyle Anderson

The Dead Weather — the garage-blues supergroup consisting of Jack White, the Kills' Alison Mosshart, the Raconteurs' Jack Lawrence and Queens of the Stone Age's Dean Fertita — famously put together their debut album Horehound in only two weeks, which is an impressive feat by any standard. And according to White, the initial surge of creative energy hasn't ebbed in the slightest, so much so that the band already has enough new songs to make a second album, which they intend to do this fall.

"We're really amped up to record the next record," White told MTV News backstage at the Outside Lands Festival. "We've got a lot of songs cooking right now — 12, 13, 14, 15 ... I don't know how many. We've gone in and recorded a little on the last break, and hopefully in the fall we'll try to find a window where we can go in there and do some more."

White also explained that the tour has not only yielded new songs but has also informed the older tunes. "It's changing every day, and we want it to change even more. We've got a lot more material going and changing a lot of the songs from the first record. We have a lot more cover songs than when we started too." Which covers have they been playing around with? "It ranges from Christian metal to Christian gospel."

The Dead Weather have a bit of downtime in September where they may work on music before hitting the road again for the month of October, giving them plenty of time to practice their evangelical tunes and engage in their writing process. "While Jack is napping on the tour bus, I'll sort of hover around him with a Moleskine handbook and write whatever things he says out loud in his sleep," White explained. "Then I'll go over to Dean's side of the bus and he's usually humming something, but he's awake. I'll try to mix these two together, run it by the judge here [Mosshart] and before you know it, we've got Morehound."

Nelly Furtado, Kooks, Mash-Up Masters Go 'Crazy' With Gnarls Covers

Rash of reimaginings ranges from insanely good to just plain insane.
By Gil Kaufman

Gnarls Barkley
Photo: Matthew Donaldson

Every summer has one — that inescapable hit song that blankets radio and TV and becomes so mainstream, so massive, that it enters the repertoires of other artists who just can't deny its hook.

Call it the "Since U Been Gone" effect.

This summer it seems Gnarls Barkley's slice of sunnily depressive soul, "Crazy," is that song, and everyone from Nelly Furtado to British buzz-band-of-the-second the Kooks couldn't resist putting their own spin on it.

U.K. soul singer Terri Walker, former Afghan Whigs frontman Greg Dulli's Twilight Singers and singer/songwriter Ray LaMontagne have all weighed in with unique versions. And mash-up artists have also been bitten by the bug, chopping up the irresistible bass bounce and hook with everything from old-school Prince and Aussie indie rockers the Avalanches to '60s girl group the Shirelles, classic rockers Supertramp and '90s one-hit wonder Skee-Lo in a rash of bootlegs.

Covers of the song — which set a record in England earlier this year by becoming the first digital download to debut at the top of the singles chart — can be found all over the Net. Curiously, the group has tried to stop the "Crazy" train before it gets out of hand. As the record reached its ninth week at #1, the duo of producer Danger Mouse and singer Cee-Lo asked that it be deleted from the U.K.'s list before people got tired of it.

Though the pair declined through their label to comment on the props from their peers, we grabbed as many decent versions as we could and gave them a spin to provide you with a guide to the insanely good and just plain nutty.

Assuming, of course, that you're not already sick of it.

Who: Nelly Furtado
Why you know her: She's competing with Gnarls, thanks to her summer smash, "Promiscuous."
What it sounds like: Furtado performed a quiet version of the song on a BBC radio show recently, accompanied only by acoustic guitar. Breathily crooning the song in a Norah Jones style, her smoky, downtown jazz-club vibe is the most low-key of the bunch.
Verdict: Kinda nutty

Who: Twilight Singers
Why you know them: Singer Greg Dulli was known for doing offbeat Motown covers with the Afghan Whigs, and his latest project has tackled artists ranging from Mary J. Blige and Stevie Wonder to Fleetwood Mac and George Gershwin.
What it sounds like: At a May 29 show at the Paradise in Boston, Dulli mellowed things out, giving Gnarls singer Cee-Lo a run for his money in the gravelly vocals department. The singer takes the uptempo song for a late-night, drunken-crooner makeover, thanks to brushed drums, piano and some spare guitar.
Verdict: Definitely a bit deranged

Who: Ray LaMontagne
Why you know him: The folk-oriented singer/songwriter released the blue-eyed soul album Trouble in 2004, garnering comparisons to everyone from Van Morrison to Tim Buckley.
What it sounds like: Kind of like a Richie Havens tune from 1968. The husky, scratchy-voiced LaMontagne transforms the song into a Woodstock-era acoustic anthem with a healthy dollop of impassioned folk/soul and a bit of improvised scatting at the end.
Verdict: Certifiable

Who: The Kooks
Why you know them: You probably don't ... yet. The latest English buzz band of retro-rocking teens has released a string of hit singles in the U.K. and recently made its American debut at the South by Southwest music conference.
What it sounds like: Seemingly the ones who kicked off the trend with their cover from March — the same month the song was released digitally overseas — singer Nick Pritchard slathers the song in a slack, British, indie sensibility. The acoustic-guitars-and-spare-drum take is a bit hippy-dippy, but Pritchard's squeaky, nasally voice and marble-mouthed delivery give it a nice edge.
Verdict: Sorry, but kinda kooky

Who: Terri Walker
Why you know her: Yet another testament to Gnarls' effect on the British music scene, Walker is a twentysomething North London R&B sensation who has yet to make it in the U.S. but whose 2003 debut, Untitled, snagged her a nomination for England's prestigious Mercury Music Prize.
What it sounds like: The female Cee-Lo (scratchy voice and all — do you sense a pattern here?) busts out a kinda bossa-nova soul version of the track in a live recording. A bit Jill Scott, a bit Erykah Badu, the funky cover retains the original's ragged R&B edge but replaces Danger Mouse's thick sonic backdrop with a jazzy guitar.
Verdict: A bit mad, a bit sad, but definitely not bad

Jack Johnson Previews New Songs From To the Sea At Free Concert

Johnson took the album title literally, performing for fans at Santa Monica's famed pier.
By Matt Elias

Jack Johnson
Photo: MTV News

SANTA MONICA, CaliforniaJack Johnson took fans to the sea (literally) on Monday night to celebrate the release of his aptly titled new album To the Sea. The free concert was given to show appreciation for fans who took part in a beach cleanup on Saturday in Santa Monica, which was organized by Southern California nonprofit Heal the Bay.

Three thousand fans with free tickets covered a large portion of Santa Monica's iconic pier for the show. An almost equal amount who weren't able to score tickets lined the beach below with blankets (which came in handy on the unseasonably cold night).

Prior to the show, the crowd below was treated to a rare opportunity to hear the man of the night and his band's soundcheck — thanks in part to the open-air stage. In between songs, the troubadour shouted out to those below, generating enthusiastic responses from the growing crowd.

Following the soundcheck, Johnson told MTV News how special the pre-show audience was. "A lot of times in soundcheck, we end up just not playing a whole song because it's just us and we've heard it enough times," Johnson said. "But once there's people listening — even if it's 10 or 15 — we usually play a whole song because it's just nicer to listen to. So this time we had what looks like a couple hundred people at least for a soundcheck. But it was fun. We just played a song that we're not gonna play tonight — might as well use that one."

While some fans might think it's unusual to catch Johnson in such an intimate setting, he continues to play smaller stages back home in Hawaii, mostly for his own nonprofit, the Kokua Hawaii Foundation. Usually in classroom settings, Johnson embraces the unpredictability of not having his road crew with him to set up a professional sound system (he says it's usually "just me and the guitar").

And on the eve of the release of his fifth studio album, To the Sea (due June 1), the singer/songwriter shared his philosophy on playing new and for the most part never-heard-before songs during his set.

"I think there will be a couple of the new songs, kind of finding that balance. Because I just know from being a music fan and going to shows as well, I like hearing some new stuff, but definitely want to hear a lot of the old ones that you already identify with," Johnson said.

True to his words, later that night Johnson sprinkled some new tunes in with his established crowd favorites. He and his band took the stage shortly after 8 p.m. and jumped right into the lead single from To the Sea, called "You and Your Heart." Acknowledging a few missed chords, Johnson ended the song by saying, "The reason this show is free is because we haven't played in a month."

The crowd chuckled with him and it set the tone for the loose and free-flowing show. "If I Had Eyes" was next, followed by the Curious George soundtrack song "Upside Down," which drew a collective "Aww" from the crowd when Johnson dedicated it "to the little girl with the beanie on her head" who was hoisted on her dad's shoulders.

Next up were a series of pairings that Johnson and the band segued into without pausing. They followed "Flake" with the Steve Miller Band classic "The Joker." "Do You Remember" went into "Bubbly Toes," which drew a raucous sing-along on the "la da da da da da's." They ended the night's pairings with the crowd favorite "Inaudible Melodies" and "Good People."

Some of the new songs that made it into the set were "To the Sea," "From the Clouds," and "At or With Me."

Highlights of the night included pianist Zach Gill's efforts to keep the crowd warm by initiating an audience-wide pogo jump, bassist Merlo Podlewski's rap on "Staple It Together," and most of all, Johnson's solo encore of "Better Together," which brought a hush across the crowd, then a whispered sing-along of the tune. And there was no better way to end the night.
